An Issue with my Henry 45-70

I just brought home my new Henry 45-70 only to find that when I try and load it the lever pops open unless you hold the lever shut, this is with the rifle at a slant not straight up and down, and as soon as you open the lever alittle bit to see if the gun is loaded , the lever wont close you have to cycle the action completely to close the lever, but I noticed if I take the mag tube out the lever will close. What causes this????? I already contacted Henry about the issue and they already sent me pre paid shipping label to send it back, but i was hopeing to find out what the issue is, maybe it's something simple i can fix myself. Anyone else have this happen or knows how to fix it?

that has been a problem reported with some and Henry does have a correction .... not surprised to hear they moved quickly to make it right

Go with Henry all the way before you try your own repair. They will make it right!

Oh I am glad Henry has such great customer servise, I was just curious as to what exactly is causing the problem. Seems some guns have it some don't, my inspection tag that came with the gun was dated from September of 2015, serial number starts with a W so I suppose it was made in the Wisconsin factory.

Doesn't it have the location imprinted on the barrel? All of my Henrys have had the city/state there, e.g. my SGC is marked Bayonne, NJ.

Henry can fix this and I am confident they will. They fixed mine. The lever would pop open after rounds where loaded if the lever was slightly bumped or the but stock was bumped lightly, not a good thing for having on a sling out hunting. Now I could throw the gun off a two story window and that lever would not open but it opens and cycles smooth when you need it too.

I know how disappointing it is to have a problem like this on a new rifle, but it's a Henry; be assured you will be very happy with it very soon.

Does yours have the semi-buckhorn rear sight or the peep sight? And does it have the updated mag tube mounting system/front sight?

They supposedly fixed this problem along with the introduction of the new sights, but mine (June 3, 2016 packing date) did it one time then seems to have resolved once I learned to rotate the inner mag tube while seating it.

It is indeed a frustrating problem, and while they will fix it I'm still surprised it got past the engineers to start with. This is Henry, after all!

I just looked and mine was made around September 15 2015, and the rifle was indeed made in Rice Lake, Wisconsin. I have no doubt Henry will make it right, I'm gonna get it ready to ship out sometime this week. Thanks guys for all the responses, I'll post an update whenever I receive the rifle back....

Midnight rider, yes mine has the new sight system and yes the mag tube is dovetailed into the barrel, I actually got my lever to close but you have to pull the lever pretty hard and it chews the hell outta the rim of the case. The cases have an indent on the rim like something was pressed into the brass. Still doesn't seem like you should have to pull on the lever that hard to close the action.

High mountain, it does sound like yours might need to take a quick trip in to the mother ship.

I'd let Henry fix it, I'll bet they get on it fast too.
They want happy customers. Now & then one of anything leaves the factory needing adjustment, my Wife reminds me of this now & then. I think Henry will fix it & fix it quickly.

Well fellas I gotta say Henry fixed my gun!!!! Had it back in my hands in a week and a half from the day I shipped it, now that is FAST! They replaced 4 different components 3 being in the receiver. Works like a charm now, slick as mule snot!! Now I just gotta wait for all my casting supplies to arrive and i m gunna be having me some fun...

Great to hear highmountian. Mine came back slick and they must have worked on the trigger because it breaks like a glass rod. Almost as good as my 1911s.

Give us a range report when you can.
